Welcome to John Dublin. The terms "we", "us" and "our" refer to John Dublin. We operate this shop and this website, including all related information, content, features, tools, products and services, in order to provide you as a customer with a curated shopping experience (the "Services"). John Dublin is provided through Shopify, which enables us to offer you the Services.
The following Terms and Conditions, together with the policies referred to within them (these "Terms and Conditions" or "Terms"), form the basis of your rights and obligations when using the Services.
Please read these Terms and Conditions carefully. They contain important information about your legal rights and cover matters including warranties and limitations of liability.
By accessing, using or interacting with our Services, you agree to these Terms and Conditions and to our Privacy Policy. If you do not agree with them, please do not use the Services.
Section 1: Access and Account
By agreeing to these Terms and Conditions, you confirm that you are at least 18 years old or have reached the age of majority in your federal state, and that you have given your consent for any minors in your care to use the Services on devices that you own, purchase or manage.
In order to use the Services – for example to browse our shop or to purchase products – we may ask you for certain information, such as your email address as well as billing, payment and delivery details. You warrant that all information you provide in our shop is accurate, current and complete, and that you are authorised to provide this information.
You are solely responsible for the security of your login details and for all activity in your account. You may not transfer, sell, assign or license your account to any third party.
Section 2: Our Products
We make every effort to present our products and services in the shop as accurately as possible. Please note, however, that colours and appearance may differ from what is shown on your screen depending on the device used and its settings and configuration.
We do not warrant that the appearance or quality of the products or services you purchase will meet your expectations or match how they are presented in our shop.
All product descriptions may be changed at any time at our discretion and without prior notice. We reserve the right to discontinue individual products at any time and to limit the quantities offered per person, geographical region or jurisdiction on a case-by-case basis.
Section 3: Orders
By placing an order, you are making a binding offer to purchase. John Dublin reserves the right to accept or decline orders at its own discretion. A contract is only formed once we confirm acceptance of your order. Before acceptance, we must have received and processed your payment.
Please check your order carefully before submitting it – once accepted, we may no longer be able to accommodate cancellation requests. If we do not accept an order, or if we amend or cancel it, we will try to reach you using the email address, billing address and/or telephone number provided with the order.
Returns and exchanges are governed by our Returns and Refunds Policy. This does not affect your statutory right of withdrawal.
Section 4: Prices and Payment
Prices, discounts and promotions may change without prior notice. The price that applies is the one in effect at the time you place your order and shown in the order confirmation email. Unless expressly stated otherwise, all prices are final prices in euros and include statutory VAT. Shipping and handling costs may apply in addition and will be shown before you complete your order.
Prices in our shop may differ from prices in third-party shops. From time to time we offer promotions that may affect pricing and may be subject to their own terms. If promotional terms conflict with these Terms and Conditions, the promotional terms take precedence.
You undertake to provide current, complete and accurate purchase, payment and account details for all purchases in our shop, and to keep these up to date – including your email address, card number and expiry date – so that we can complete your transactions and contact you if necessary.
You warrant that (i) the payment details you provide are accurate and complete, (ii) you are authorised to use the payment method chosen, (iii) the charges initiated will be accepted by your payment provider, and (iv) you will pay the amounts charged at the prices shown, including shipping, handling costs and any taxes.
Section 5: Shipping and Delivery
We are not liable for delays in shipping and delivery. All delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers or by events beyond our control. Once we hand products over to the carrier, ownership and the risk of loss pass to you. For consumers, however, the risk of accidental loss or accidental deterioration of the goods sold does not pass until the goods are handed over to the consumer.

Section 6: Intellectual Property
Our Services, including all trade marks, text, images, graphics, product reviews, video and audio materials, as well as their design, selection and arrangement, are the property of John Dublin, affiliated companies or our licensors, and are protected under German, European and other applicable copyright and trade mark law.
These Terms and Conditions permit you to use the Services solely for personal, non-commercial purposes. Without our prior written consent, you may not reproduce, distribute, modify, create derivative works from, publicly communicate or perform, republish, download, store or transmit content from the Services. Except as expressly set out in these Terms and Conditions, no licences or other rights to patents, trade marks, copyrights or other intellectual property of John Dublin, Shopify or third parties are granted to you. Unauthorised use may constitute copyright infringement. All rights not expressly granted are reserved.
The name, logo, product and service designations, designs and slogans of John Dublin are marks of John Dublin or our licensors and may not be used without prior written permission. The Shopify name, logo and marks are trade marks of Shopify. All other names, logos, product and service designations, designs and slogans within the Services are marks of their respective rights holders.
Section 7: Optional Tools
You may be given access, as part of the Services, to third-party tools that we neither monitor nor control or influence.
We provide access to such tools "as is" and "as available", without warranties, representations or conditions of any kind, and without thereby making any endorsement. We accept no liability for damages arising from the use of optional third-party tools, to the extent permitted by law.
Use of such tools is at your own risk and discretion. Please make sure that you are familiar with and accept the terms of the relevant providers.
Any new features and tools offered in future are also deemed part of the Services and are subject to these Terms and Conditions.

We are not responsible for reviewing or assessing the content and accuracy of such materials or websites. If you leave the Services to access this content or these pages, you do so at your own risk.

Complaints, claims and questions regarding third-party products and services should be directed to the relevant provider.

John Dublin is provided through Shopify, which enables us to offer you the Services. Purchases and sales in our shop are, however, made directly with John Dublin. By using the Services, you acknowledge that Shopify is not responsible for any aspect of the sales between you and John Dublin, including any injury, damage or loss in connection with products and services purchased. You release Shopify and its affiliated companies from claims, damages and liability in this respect, to the extent permitted by law.
Section 10: Privacy Policy
All personal data we collect through the Services is subject to our Privacy Policy; certain data may additionally be subject to Shopify's Privacy Policy. By using the Services, you confirm that you have read these policies.
As the Services are hosted by Shopify, Shopify collects and processes personal data about your access and use in order to provide and improve the Services. Information you submit to the Services is shared with Shopify and with third parties, who may be located in countries other than your country of residence. We are under no obligation to treat Feedback as confidential, to pay any compensation for it or to respond to it.
We are entitled, but not obliged, to monitor, edit or remove Feedback that we consider, at our own discretion, to be unlawful, offensive, threatening, defamatory, libellous, pornographic, obscene or otherwise objectionable, or that infringes the rights of third parties or these Terms and Conditions.
You warrant that your Feedback does not infringe any third-party rights – in particular no copyright, trade mark, personality or other rights – and contains no unlawful, offensive or obscene content, viruses or other malicious software that could impair the operation of the Services. You may not use false email addresses, impersonate another person, or mislead us or third parties about the origin of any Feedback. You are solely responsible for your Feedback and its accuracy. We accept no liability for Feedback published by you or by third parties.

Occasionally, the Services may contain information that includes typographical errors, inaccuracies or omissions – for example relating to product descriptions, prices, promotions, offers, shipping costs, delivery times or availability. We reserve the right to correct such errors, to change or update information at any time without prior notice, and to cancel orders where information was incorrect – including after you have submitted your order.

You may use the Services for lawful purposes only. It is prohibited to use them, directly or indirectly: (a) for unlawful or harmful purposes; (b) to breach international, federal, state or local regulations; (c) to infringe our intellectual property or that of third parties; (d) to harass, abuse, insult, harm, defame or intimidate any person; (e) to submit false or misleading information; (f) to send, receive, upload or download, or make use of, material that contravenes these Terms and Conditions; (g) to send unsolicited advertising, including chain letters and spam; (h) to impersonate another identity; or (i) for any other conduct that restricts or hinders others' use of the Services or that, in our assessment, could harm John Dublin, Shopify or users of the Services.
It is likewise prohibited to: (a) upload or transmit viruses or other malicious code that may impair the functioning of the Services; (b) reproduce, copy, sell, resell or exploit any part of the Services; (c) collect or track the personal data of other users; (d) spam, phish, pharm, spider, crawl or scrape; or (e) circumvent or compromise the security measures of the Services or related websites.
In the event of breaches of these Terms and Conditions, we reserve the right to suspend, deactivate or terminate your account.
Section 14: Termination
We may terminate this agreement or your access to the Services or parts thereof at our reasonable discretion; you remain liable for any amounts due up to the point of termination.
The following provisions survive termination: Intellectual Property, Feedback, Termination, Warranty, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature are intended to survive.
Section 15: Warranty
The information provided through the Services is intended for general information purposes. We give no guarantee as to its accuracy, completeness or usefulness; any reliance on it is at your own risk.
The statutory rights in respect of defects apply to the goods delivered. The limitation period for warranty claims is two years from delivery of the goods for consumers, and one year from delivery for business customers. Your statutory consumer rights are not restricted by these Terms and Conditions.
Section 16: Limitation of Liability
We are liable without limitation for damages arising from injury to life, body or health caused by a negligent or intentional breach of duty by us, our legal representatives or our vicarious agents, as well as for damages covered by liability under the German Product Liability Act.
In the case of a breach of material contractual obligations (cardinal obligations), our liability is limited to the foreseeable damage typical for this type of contract, where such damage was caused by simple negligence. Cardinal obligations are those obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely.
Otherwise, liability for simple negligence is excluded. Mandatory statutory grounds of liability remain unaffected.
Section 17: Indemnification
You will indemnify John Dublin, Shopify and our affiliated companies, partners, directors, employees, representatives, contractors, licensors and service providers against third-party claims, damages, liabilities and demands, including reasonable legal costs, arising from (1) your breach of these Terms and Conditions or the documents incorporated within them, (2) your breach of any laws or third-party rights, or (3) your access to and use of the Services.
We will notify you of any such claim; late notification releases you from your obligations only to the extent that it causes you material disadvantage. We may conduct the defence and settlement of such a claim at your expense, including the choice of legal representation, but will not enter into any settlement imposing non-monetary obligations on you without your consent; such consent may not be unreasonably withheld. You will cooperate in the defence, in particular by providing relevant documents.
Section 18: Severability
Should individual provisions of these Terms and Conditions be or become invalid, void or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be deemed severed from these Terms and Conditions; its invalidity does not affect the validity and enforceability of the remaining provisions.
Section 19: Waiver; Entire Agreement
If we do not exercise a right or provision of these Terms and Conditions, or do not do so immediately, this does not constitute a waiver of that right or provision.
These Terms and Conditions and all policies published by us on this website or in relation to the Services constitute the entire agreement between you and us and govern your use of the Services. They supersede all prior or contemporaneous oral or written agreements, communications and proposals between you and us, including earlier versions of these Terms and Conditions.
In interpreting these Terms and Conditions, any ambiguities shall not be construed against the party that drafted them.
Section 20: Assignment
Without our prior written consent, you may not transfer, assign or delegate this agreement or your rights and obligations under it; any attempt to do so is invalid. We are entitled to transfer or assign these Terms and Conditions and our rights and obligations without your consent.
Section 21: Governing Law and Dispute Resolution
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration body.

The headings used in this agreement are for ease of reference only and do not affect the interpretation of these Terms and Conditions.

You can view the current version of these Terms and Conditions on this page at any time.
We reserve the right to update, amend or replace parts of these Terms and Conditions by publishing updates and changes on our website. It is your responsibility to check our website regularly for changes. We will inform you of material changes in accordance with applicable legal requirements; such changes take effect at the time stated in the notice. If you continue to use the Services after changes have been published, this constitutes acceptance of the amended version.
